VAT and Listed Buildings

In the Budget back in March this year, the Government announced its intention to levy VAT on any works to a Listed Building from 1st of October 2012.

However, following a period of considerable debate, whilst VAT on approved alterations will still be implemented from the 1st October this year, there were two major alterations to the legislation as a result of representations put forward; i.e.:

1. Providing owners had applied for Listed Building Consent before 21st March this year zero rating will still apply for approved alterations (originally work had to have been started or a written contract in place before 21st March.

2. Owners now have until 1st October 2015 to complete the work instead of 1st October this year.

So if you have delayed implementing any works with Listed Building Consent there is a 3 year window of opportunity to take advantage of the Vat relief.

June has been a very good month for JBA Ltd as we have taken instruction on four new projects. Ranging from a domestic extension all the way though to a executive residential scheme, JBA Ltd continue to build upon recent success and attract new clients.

New House Up date

Following a period of intense activity, the external fabric of the house is nearing completion. Once fully weather tight work will continue internally to complete the fit out. If all things proceed to plan, it is envisaged handover to the Client will take place at the end of September.

Crinkle Crankle Wall - Planning Permission at last.

After a number of years hard work JBA Ltd have finally managed to secure Planning Permission for the conversion of the barn adjacent to the Crinkle Crankle Wall to a dwelling.

At the East Area Planning Committee meeting on Wednesday 20th June, Members voted 5:3 in favour. This does not mean that work can start immediately as there is a pre-commencement condition that requires discharging within 2 months of the date of the Permission.

Cow byre restoration phase 2

Works have commenced on the restoration of the cow byre and Bryan Sabin from Shipston on Stour has been appointed as the Main Contractor for the works. 

The works are being undertaken with assistance from Natural England to secure the long term future of this historical agricultural building.

Following a period of technical assessment by Natural England, JBA Ltd have invited a number of local craftsmen to tender for the individual trades associated with the restoration.

The tenders are due at the end of April with works commencing on site shortly thereafter.

Following submission of our report and recommendations for the restoration of the cob walled cow byre, Natural England have confirmed their acceptance and have instructed JBA Ltd to proceed with Phase 2. 

Phase 2 requires the detailed production drawings and specification of materials to enable suitably experienced craftsmen to tender competitively for the works. It is envisaged that works will commence on site in early April.

JBA Ltd is delighted to have been appointed to provide a Management Plan for the proposed restoration of an early Cow Byre of Cob Wall and Thatch construction at Tidmington Farm, Shipston on Stour.

The first phase will involve identification, evaluation and understanding the separate historical, wildlife and landscape values of the building such that there is an appropriately detailed record of any structural or internal features of historical significance.

The drawn document will form a permanent archive record of the building and serve to form the basis for the second phase which will entail the provision of a detailed Specification and Schedule of Works, Tender and Report to carry out works required to bring the building back to good repair based on the "informed conservation" approach and having due regard to the information and evidence gleaned during phase 1.

The intention is to complete both phases according to a brief provided by Natural England such that the resultant works will be eligible for grant funding.

In addition, we have recently secured two further projects in the Chipping Campden area, one of which requires monitoring of the works on site and certification for the mortgage lender. 

Our Chartered Architect David Edwards BA (Hons) Arch, Dip Arch, RIBA has the necessary qualifications and experience to sign the declaration for the mortgage lender and the Practice has the required level of Professional Indemnity Insurance cover in place.

New House - Update

As we head in to the Christmas holiday period, work begins to slow down in readiness for the closure of the site. Since the last update the Contractor has progressed well, with the external and internal walls of the lower ground floor now complete. 


The blockwork for the internal and external walls for the ground floor are reaching ceiling height and the external stonework is coming out of the ground. The garage is approaching wall plate height and the roof should be commenced in the early New Year.

Taking on the Planning Inspectorate

Group Directors Bruce Frizzell and David Holland met yesterday with Counsel from No5 Chambers in Birmingham to discuss commencing a judicial review in to procedural irregularities in relation to a dismissed appeal. Following a lengthy discussion it has been resolved to press forward with seeking a judicial review and to seek After The Event insurance to cover the costs. 

The Group Directors are also attending a briefing session provided by No5 Chambers next week on the mechanics of bringing and defending High Court challenges to administrative decisions.
